When First Amendment conflicts erupt at U.S. Supreme Court, it's time to ask WWDD?

Over a three-day period, 47 “friend of the court” briefs suddenly clogged the inbox at the U.S. Supreme Court regarding the most important religious liberty case of this term -- if not of the coming decade. This is a crucial First Amendment showdown.

Almost all these briefs opposed Colorado’s use of an anti-discrimination law against Masterpiece Cakeshop for refusing to provide the cake for a same-sex wedding.

The immediate issue is the fate of certain religious bakers, florists, photographers, Orthodox Jewish catering halls and the like. In a parallel case, Oregon fined a bakery $135,000, demonstrating government’s power to penalize dissenters or put them out of business. Beyond that lie important rights claims by  conscientious objectors that the Supreme Court did not address when it legalized gay marriages nationwide in 2015 (.pdf here).

The Cakeshop’s pleas for freedom of religion, conscience, and expression are backed in briefs from the Trump Administration, 11 Republican U.S. Senators and 75 House members, 20 of the 50 U.S. states led by Texas, a host of social conservative  and “parachurch” agencies, and America’s two largest religious bodies (Catholic Church, Southern Baptist Convention).

Yet to be heard from are “mainline” Protestant and non-Orthodox Jewish groups that support the gay cause.

This past week the court received briefs from the American Civil Liberties Union (.pdf here) on behalf of the gay couple and from Colorado officials (.pdf here). Repeating past contentions, the briefs contend that religious liberty claims cannot justify exemptions from anti-discrimination laws that are “neutral” and “generally applicable,” whether religious or secular in motivation. As Colorado sees things, the Constitution offers no support for a business “to treat a class of people as inferior simply because of who they are.”

Are conservative news media downplaying the brutal crackdown against Egyptian gays?

Depending upon your point of view — and in their purist iterations — demands for equal rights for gay people are either about justly extending social and legal parity, or a moral struggle to uphold traditional religious doctrine and cultural ideas about sexuality and gender.

Either way, homosexuality is one of the three biggest culture war issues dividing Americans, along with questions about abortion and the legal parameters of religious freedom.

It's also a prime issue internationally. Globalization has fostered the spread of contemporary Western liberal values. That, in turn, has prompted push back in some non-Western nations enmeshed in the global market’s whirlwind of change.

Some of the more recent stories referencing the issue have come out of Egypt, where homosexuality, while not explicitly outlawed, is harshly condemned by the majority Muslim and minority Coptic Christian religious establishments.

Every so often Egypt’s authoritarian government, led by President Abdel Fatah al-Sissi, appears to use the issue as a political cudgel to bolster support among Muslim and Christian traditionalists, who together comprise the vast majority of the nation’s population.

Is Catholic doctrine allowed at a Catholic university? That's the pressing question at Georgetown

Is the pope Catholic? We've had fun with that question a time or two.

But here's a more pressing question: Is Catholic doctrine allowed at a Catholic university?

In case you've missed this week's headlines, I'm talking specifically about Georgetown University.

I first became aware of this controversy when I saw a tweet from Fort Worth, Texas, Bishop Michael Olson, who asked:

Is there really no room for students who support and accept the Catholic teaching on marriage at this Catholic University?

The Washington Post has a pretty extensive story — fairly quoting sources on both sides — on what's happening:

A Catholic student group at Georgetown University that promotes the benefits of traditional marriage risks losing its funding and other university benefits after being accused of fostering hatred and intolerance.
Love Saxa advocates for marriage as “a monogamous and permanent union between a man and a woman,” the group states in its constitution.  That definition of marriage happens to be in line with that espoused by the Catholic Church, raising the question of how administrators at Georgetown, the United States’ oldest Catholic and Jesuit institution of higher learning, will handle the controversy if it eventually comes before them.
“I suppose the question for Georgetown is whether they think Catholic kids can still be Catholic there,” said Chad Pecknold, a theology professor at the Catholic University of America.
About half of the student body identifies as Catholic, according to the university. Seventy-five percent of Catholics ages 18 to 29 favor same-sex marriage, compared with 22 percent who oppose it, according to the Pew Research Center.
Two students lodged a complaint against Love Saxa, arguing that the group’s definition of marriage violates university standards governing sanctioned student groups and demanding that it be defunded and removed as an officially sanctioned student group. The complaint stops short of calling for the group to be banned. Student organizations, per university rules, are ineligible for funding and other benefits if they “foster hatred or intolerance of others because of their race, nationality, gender, religion or sexual preference.”

Cutting shrinking pies: The Baltimore Sun bravely looks into liberal pews seeking signs of life

How long have journalists been writing stories about the decline of America's liberal mainline churches, both in terms of people in the pews and cultural clout?

I've been studying religion-news coverage since the late 1970s and I cannot remember a time when this was not "a story." For many experts, the key moment was the 1972 release of the book "Why Conservative Churches Are Growing" by Dean M. Kelley of the National Council of Churches.

You could argue, as I have many times on this blog, that the decline of the oldline left is a story that deserved even more press coverage than it has received. Why? Because the decline of the old mainline world helped create a hole in American public life that made room for the rise of the Religious Right.

Now we have reached the point, as "Crossroads" host Todd Wilken and I discussed in last week's podcast, where the story has become much more complex. While the demographic death dive has continued for liberal religious institutions (as opposed to spiritual-but-not-religious life online and elsewhere), we are now seeking slow decline in parts of conservative religious groups, as well.

What's going on? To be blunt, religious groups are growing or holding their own when they inspire believers to (a) have multiple children, (b) make converts and (c) live out demanding forms of faith that last into future generations. Yes, doctrine matters. So does basic math.

With this in mind, consider the brave attempt that The Baltimore Sun made the other day to describe what is happening in churches in that true-blue progressive city. Here is the overture and, as you read it, get ready for an interesting and, apparently, unintentional twist in the plot:

Maybe there's a story here: Lutherans on left, right share some common decline issues

If you hang out in the world of organized religion for several decades -- either as a participant, a reporter-outsider or both -- then you reach a point where there is something refreshing about reading an honest report by a faith-based group that's trying to address a real problem.

It's so easy to ignore problems, year after year, until you look up one day and your pews contain a dozen or so people over the age of 70. The next thing you know, you're trying to see how many nonprofits can lease space in your building so that you can keep the heat on and the doors open.

Sound familiar? Plot lines linked to declining numbers and aging sheep have been getting more and more prominent in recent decades, especially among the oldline Protestant churches on both sides of the Atlantic. That's an old story. We talked about that story in this week's "Crossroads" podcast (click here to tune that in), but only because it was linked to something more complex and, I think, more interesting.

You see, many churches on the doctrinal right are facing some -- repeat "some" -- of the same issues as those on the left. Yes, there is some truth to the claims that American Catholics have been able to hold things together because of rising numbers in Hispanic parishes (while also importing some priests from the Global South). Southern Baptists have drifted into a slight decline, facing numbers that are not as staggering as those seen in the "Seven Sisters" on the Protestant left, but they are bad (especially when it comes to baptisms). The old-guard SBC knows that continued growth among African-American and Latino churches is crucial.

So this brings me to a report that I bumped into last year published (.pdf here) by the Lutheran Church-Missouri Synod in its Journal of Lutheran Mission. What's it about? It's about the 40 years or so of decline in membership in the churches of this conservative synod, a decline that is quite similar to that seen on the left.

* ... (A)ll denominations gain the overwhelming majority of their membership from natural growth: from children of adult members raised in the faith. Thus, the retention of baptized and confirmed youth is a key area on which to focus.
* The LCMS’s persistent, long-term decline manifests itself both in a massive decrease in child baptisms (down 70 percent since their peak in the late 1950s) and a smaller but still significant decrease in adult converts (down 47 percent since their peak, again in the late 1950s).

Set the WABAC machine for when? Time for another trip into United Methodist polity!

As veteran journalists know, sometimes there are stories that seem really, really big when you read the press releases, but they turn out to be business as usual when you dig into the details.

That appears to be what happened with the Cincinnati Enquirer story (part of the USA Today network) offering on update on one of the many legal battles unfolding in the United Methodist Church about the status of LGBTQ ministers. The headline: "Gay Methodist minister David Meredith, church claim victory."

It's a very familiar story, part of a familiar ecclesiastical puzzle that has been in place since (wait for it) 1980. How many years ago was that? Let's put it this way: I wasn't even working full-time on the religion beat at that point.

We will return to the WABAC machine angle of this story in a moment. First, let's look at the story that the Enquirer thought it had, as opposed to what appears to have happened. The key question: Is this a local story, a regional story or a national/global story? Here is the public-relations release overture:

Claiming victory for LGBTQ members of the United Methodist Church nationwide, officials told The Enquirer on Wednesday that two of three charges against a Clifton congregation's openly gay pastor, David Meredith, were not certified
The Rev. Meredith appeared Sunday before the Methodist Committee on Investigation in Columbus, Ohio. Several complaints were filed against Meredith after his May 2016 marriage to his significant other of 29 years. Meredith and Jim Schlachter were married in a Methodist church by a Methodist minister.
Meredith was not charged with being a self-avowed practicing homosexual or with immorality.
Clifton United Methodist Church, whose membership overwhelmingly supports its pastor, said the case may be the first time in denominational history that a charge relating to homosexuality reached the investigative body and was dismissed. A charge of disobedience was certified.

This just in! Lutheran left tests theory that progressive doctrine is key to church growth

From the first days of this blog, I have argued that religion-beat professionals need to dedicate more coverage to theological, doctrinal and cultural issues on the religious left (hardly anyone uses capital letters).

Why? Consider this equation: One of the biggest news stories of the late 20th Century was the rise -- in terms of public-square clout in America -- of what became known as the Religious Right (almost everyone uses capital letters).

There were, no doubt about it, big stories there to cover -- especially among evangelical Protestants shaken by the Roe vs. Wade ruling. But consider this question: Were religious conservatives, to some degree, stepping into a cultural void created by decades of numerical decline among liberal Protestants? I would argue that both halves of this equation needed lots of coverage.

There have been attempts by liberal churches to fight back against the demographics that have been pulling them down, by which I mean declining numbers of converts and the cumulative impact of decades of low birthrates.

There are valid stories to cover, in all of this. Thus, I was glad to see Religion News Service dedicate nearly 1,800 words to a feature about church-growth efforts at a Bible Belt (but college-town) congregation in the liberal Evangelical Lutheran Church in America.

As things turned out, 1,800 words were not enough. Here is the overture:

CARY, N.C. (RNS) -- At a Bible study on a weekday evening, Lutheran minister Daniel Pugh paced before a group of 50 church members in cargo shorts and a plaid button-down shirt talking about Adam and Eve.
Clutching a hand-held remote he clicked through a PowerPoint presentation, telling members of Christ the King Lutheran Church that one way to interpret the story of Adam and Eve is as a coming-of-age allegory about a pair of carefree teens caught red-handed having sex.
In this, alternative reading of The Fall, the “forbidden fruit” offered to Eve in Chapter 3 may be a metaphor for sex, he said, and the “serpent” may be a metaphor for a penis.

Why did British journalists throw a PR pity party for an offended transgender activist?

Remember the news stories about the bakery in Gresham, Ore., that got sued out of existence by two lesbians? I wrote about the jaundiced press coverage of Sweet Cakes by Melissa here.

Nearly the exact same story is now playing out in British media. Sometimes when I feel depressed about the state of American media, I take a look at what’s available overseas and realize how enlightened, accurate and occasionally balanced things here are in comparison. Sometimes that is not saying much.

However, the Times of London’s take on the matter more resembled classic Fleet Street work than fair and balanced coverage. It began:

A Christian printer has refused to produce the business cards of a transgender diversity consultant because he did not want to promote a cause that he felt might harm fellow believers.
Nigel Williams, a married father of three based in Southampton, turned down the chance of working for Joanne Lockwood’s consultancy, SEE Change Happen, which offers advice on equality, diversity and inclusion.

So far, so good. That's just basic news. Then:

He wrote to her: “The new model of diversity is used (or misused) to margin­alise (or indeed discriminate against) Christians in their workplaces and other parts of society if they do not subscribe to it. Although I’m quite sure you have no intention of marginalising Christians it would weigh heavily upon me if through my own work I was to make pressure worse for fellow Christians.”

Am I right that the printer isn’t so much objecting to her being transgender as he is objecting to her use of “diversity” tactics as a cudgel?

Lockwood, 52, who has been living as a trans woman since January and changed her name in July, said she was “gobsmacked”, adding: “I was not expecting a lecture. I disbelieved this could happen in 2017. I have been distraught and cried and my wife consoled me.”

Now where have we heard this before?

Time to play 'Name That Newsroom,' as Pope Francis defends old doctrines on gender

That Pope Francis is certainly a headline maker.

Consider, for example, the current news mini-explosion about his proclamation that the death penalty is "contrary to the Gospel."

That's news and there's no doubt about it. In this case, a few -- but not all -- journalists covering the story quickly grasped that this statement had something to do with a highly troubling religious word, as in "doctrine." After all, there is this passage in the current edition of the Catholic Catechism:

Assuming that the guilty party's identity and responsibility have been fully determined, the traditional teaching of the Church does not exclude recourse to the death penalty, if this is the only possible way of effectively defending human lives against the unjust aggressor.

Now, this is not the normal kind of controversy that surrounds Pope Francis, when it comes to news coverage.

Most of the time, as your GetReligionistas have noted many times, what is interesting is to notice the degree to which some of the pope's comments make major news and some do not. You know, like the fact that there are, at the moment, almost a half million Google hits when you search for the phrase "Who am I to judge?"

With that in mind, let's play a little news game linked to the papacy. No, we're not going to play "Name that Pope," comparing quotations from Pope Francis with similar statements from Pope Benedict XVI.

No, this time we are going to play, "Name that Newsroom."

The goal is to figure out which of the following recent headlines and overtures is from a mainstream news magazine and which is from one of the top publications serving the niche-news needs of the LGBTQ community. The hook for these reports is the latest Pope Francis statement defending church teachings on gender.
