More on 'bathroom wars': Crux quotes several sides and lets you decide

Crux, you had me at "varied Catholic responses."

Just about every transgender rights article I've ever read has drawn caricatures: a hidebound, monolithic bureaucracy against earnest activists who bravely state their rights. Yesterday's Crux story is different: It cites intelligent, articulate viewpoints on more than one side.

You can see the difference right in the lede:

A controversy over transgender rights at schools and public facilities in the United States that’s been dubbed the "bathroom wars" has drawn varied Catholic responses, with bishops expressing concern over a trio of disputed government actions at the local, state and federal level, and a Catholic gay rights group supporting increased access for transgender people.

No other story I've reviewed on this controversy has carried Catholic Church views on the so-called bathroom wars. Nearly all the stories major in politician quotes; most quote liberal activists; some quote their conservative opponents;  one or two have asked a pastor or two. The largest division of Christianity, the Catholic Church, is always ignored. Except for Crux yesterday.

The article focuses on North Carolina, the battleground of laws, lawsuits and boycotts. Crux explains Charlotte's ordinance that allowed people to use restrooms and locker rooms for the gender with which they identify. Crux also cites HB2, the state law that overturned the ordinance and prevented any other cities from passing similar measures.

And the 1,500-word indepth has more than sound bites. It gives lots of space to a statement by both of North Carolina's bishops, Michael F. Burbidge of Raleigh Peter J. Jugis of Charlotte:

Is this a religion story? New HHS rules push faith-based hospitals on transgender issues

At some point, journalists need to stop and ask the following question: Is there any part of the Affordable Care Act that doesn't raise moral and legal questions for the leaders of hospitals operated by religious groups?

What about religious believers who are doctors, nurses, medical technicians or administrators? I think we'll need to deal with that hot-button religious liberty issue another day.

Right now, let's just say that I was amazed at the lack of mainstream news coverage of a recent Health and Human Services announcement about the impact of the White House's gender identity initiatives on medical care. (Click here for the actual document.) Maybe this important story got buried under the tsunami of coverage of government guidelines affecting how public schools handle transgender issues at the level of showers, locker rooms, bathrooms, etc.

Did this HHS announcement have implications for journalists who cover religion?

Apparently not. Here is the top of the short story that ran at USA Today. I missed this story in my early searches for mainstream coverage.

Insurers and hospitals can't discriminate against patients because of their gender identity under the Affordable Care Act, federal officials said Friday, but patient groups complained the rule doesn't go far enough.
The Department of Health and Human Services finalized a rule that prohibited discrimination in health care based on a long list of characteristics ranging from race to pregnancy, gender identity and "sex stereotyping."
It doesn't mean insurers have to cover all treatments associated with gender transitioning but they just can't outright deny them either. But the rule doesn't go far enough in clarifying what is discrimination, some say.

Your weekend think piece: Is it time to allow governments to define 'real' religion?

Back when I was doing my master's degree in church-state studies -- during an earlier era at Baylor's J.M. Dawson Institute -- one of the hot questions was this: Legally speaking, what is a "religion" and who gets to define what is and what is not a religion?

It's an old question and there are no signs that it's going away. Take, for example, those online services that will ordain you as a minister. Does a piece of paper from such an operation mean that you have the legal protections provided to clergy? How about your tax status?

You can see related questions surface in debates about, oh, the First Church of Cannabis. Is smoking weed and seeking enlightenment a tax-exempt, protected faith activity? Well, what if the people making this drug-related claim are Native Americans and the tradition goes back for centuries?

More? How about the status of Scientology in Germany?

So how do you know you are dealing with a fake or warped religious group? What was drummed into us, in our texts and lectures, was a threefold test stating that governments have every right to investigate religious groups that appear to be linked to (a) fraud, (b) profit or (c) clear threat the life and health.

But state tax officials are going to do what tax officials are going to do, which is look for more revenue.

Back in the 1980s a Colorado official decided that church-based day-care centers were not "religious." What about a non-profit organization that existed to produce books and audio-video materials for use by missionaries? That wasn't "religious," either.

It seemed like old times reading a recent piece at The Atlantic that ran under this epic double-stack headline:

Transgender wars: Associated Press shows surprising fairness -- considering

The states struck back this week, with 11 joining in a lawsuit against the Obama administration's directive to open public school bathrooms to transgender students. But in a surprise, some mainstream media aren’t sliding into the usual cheerleader mode. The Associated Press, for one, is actually producing (gasp) fair coverage.

Let's look closer.

AP starts with the fact that, rather than enlightened North versus backward South, the suit includes states far outside Dixie:  

The lawsuit announced Wednesday includes Oklahoma, Alabama, Wisconsin, West Virginia, Tennessee, Maine, Arizona, Louisiana, Utah and Georgia. It asks a North Texas federal court to declare the directive unlawful in what ranks among the most coordinated and visible legal challenges by states over the socially divisive issue of bathroom rights for transgender persons.
The Obama administration has "conspired to turn workplace and educational settings across the country into laboratories for a massive social experiment, flouting the democratic process, and running roughshod over commonsense policies protecting children and basic privacy rights," the lawsuit reads.

Pretty forceful language, and livelier than many news articles. They typically quote a liberal or two live, rendering a nice, flowing comment -- then match it with a stiff-sounding posture from a conservative website.

AP gives valuable background in pinpointing the origins of the federal directive: a duel of lawsuits between the U.S. Justice Department and North Carolina over that state's laws requiring transgender people to use public bathrooms of their biological sex, rather than the one they identify with. When several states band together in court, it's easy to forget how they got there.

Will the waning Barack Obama administration rewrite religious hiring rules?

Church-and-state disputes are a hot beat and it's getting hotter all the time.

We have religious objections over the government’s transgender bid to control school toilets and locker rooms nationwide, the Supreme Court’s bounce back of the Little Sisters’ “Obamacare” contraception case, states’ debates over whether merchants can decline gay wedding services on religious grounds, and much else.

Media coverage to date shows little interest in how church-state policy might be affected by a President Clinton, or a President Trump, or the jurists on Donald Trump’s recent Supreme Court list, or a Justice Merrick Garland. Will this be raised at a big June 9-11 “religious right” confab in D.C.? Speakers will include Trump and former challengers Cruz, Fiorina, Huckabee, Kasich, Paul, and Rubio, plus House Speaker Paul Ryan and Senate Majority Leader Mitch McConnell.

Meanwhile, interest groups are ardently lobbying the Obama Administration to change religious hiring policies during its waning days. At issue is application of the federal Religious Freedom Restoration Act (RFRA) under the 2007 “World Vision memorandum” (click for .pdf) from the Bush Administration’s Department of Justice.

World Vision, a major evangelical organization, had landed a $1.5 million grant to provide mentoring for at-risk youths. The memo ruled that it’s legal for such religious agencies fulfilling service programs through  federal grants to consider religious faith in their hiring. The Obama White House has thus far resisted pressure to abolish that policy, most recently in a Feb. 22 letter from ranking Democrats in the U.S. House.

Caps, gowns and prison whites: Meet Texas' newest seminary-trained pastors

Another major Texas newspaper has produced an excellent feature on state-sanctioned minister training inside the Lone Star State's toughest lockups.

Back in March, I (mostly) praised the Houston Chronicle for such a story and shared some reflections of my own experience writing about religion and prisons.

I did, however, wonder why the Chronicle didn't make clear the role of the state and the use of any taxpayer money.

That background leads to the Dallas Morning News front-page Sunday feature that ran under the banner headline "Prophets of hope."

The Morning News story is colorful, nicely written and — if you are a person of Christian faith, as I am — inspiring:

ROSHARON — For a couple of hours, the maximum-security prison felt like a real church.
Daylight illuminated stained-glass windows as voices in spiritual rejoicing sent up hymn after celebratory hymn honoring 33 new pastors in black graduation caps and gowns in the chapel’s sanctuary.
Under a towering white cross, there were sermons, handshakes, hugs and thunderous applause. Joyful pride spilled down mothers’ cheeks as the graduates filed down the aisle out of the room, clutching diplomas and grinning ear to ear.
Beneath those caps and gowns were the prison whites of men whose criminal transgressions landed them behind bars for decades. Outside the chapel walls were the concertina wire and pickets manned by armed guards at the Darrington Unit, one of the toughest prisons in Texas.
The inmates were the second graduating class from the Texas Department of Criminal Justice’s seminary program. On a recent Monday afternoon, after four years of studies, the men received bachelor’s degrees in biblical studies from Southwestern Baptist Theological Seminary.
Now, they will be divided into teams and assigned to one of Texas’ 109 prison units, where they will minister to other inmates. Their aim: to help those who will soon be released find reconciliation and rehabilitation through faith.
“I want to commission you today to be prophets of hope,” seminary President Paige Patterson told the men, most of whom are serving sentences of at least 25 years.

The Washington Post puts generic faith at the heart of a family's fight to save a child

First things first: I have nothing but praise for the dramatic and very human story that unfolds in the recent Washington Post feature that ran under the headline, " ‘God is telling me not to let go’: A mother fights to keep her 2-year-old on life support."

This story focuses on agonizing choices and, in this age of soaring health-care costs, that means dealing with the viewpoints of medical-industry professionals as well as traumatized family members. Readers need to understand both points of view to grasp some of the core issues in this piece.

Also, the story doesn't hide the fact that religious faith is, for the parents of little Israel Stinson, at the heart of their fight to keep him alive. There is quite a bit of religious language in this piece, as there must be.

So what is missing? Well, if this family's faith is at the heart of their story, might readers want to know something about the details of that faith? Maybe even the name of this faith? Are they Baptists, Catholics, Pentecostals, Jehovah's Witnesses or what? Hold that thought.

Here is the overture for the story:

Two-year-old Israel Stinson was being treated for an asthma attack in an emergency room in Northern California last month when he started to shiver, his lips turning purple and his eyes rolling back in his head.
Over the next day, court records claim, Israel had a hard time breathing, went into cardiac arrest and seemingly slipped into a coma. Soon, his doctors declared him brain-dead and decided that he should be disconnected from the machine that kept his heart beating.
But his parents protested: Discontinuing medical treatment, they argued, would violate their son's right to a life -- and their hope that he might eventually have one.

Sexual assault debates: Journalists weigh in on 'licked cupcakes' at Brigham Young

No college is more averse to bad publicity than a religious school because of its heavy dependence of like-minded donors and the pressure to keep up the appearance of defending the faith. Which is why the recent contretemps about Brigham Young University’s honor code policy and campus rape victims is making the rounds in the mainstream news media.

An honor code -- or lifestyle/doctrinal covenant -- is a set of behaviors a student agrees to before enrolling. At BYU, they include everything from extramarital sex to wearing sleeveless blouses.

Let’s start with how the latest article on the controversy –- from the Los Angeles Times -- handled it:

Madeline MacDonald was a freshman at Brigham Young University when a casual date turned into what she said was a sexual assault.
The Seattle 19-year-old had met a man through the online dating site Tinder. He said he was Mormon, which put MacDonald at ease, and she agreed to meet him for hot chocolate.
They never made it to a cafe, though. Instead, the man drove her up into the mountains, and there, she says, he molested her.
Campus officials opened a sexual assault investigation. But they also opened an inquiry to determine whether MacDonald had violated the private Mormon university’s honor code, which requires that students adhere to the school’s strict rules for proper behavior -- no swearing, coffee, tea, tobacco, alcohol or premarital sex.

Theodicy in the White House race? Believers facing a choice that is more than political

The first time someone sent me the link to this obituary from The Richmond Times-Dispatch, I was sure that it had to be a fraud, perhaps something produced by those talented tricksters at The Onion.

Ah, but the URL did, indeed, take readers to the proper news website in Richmond.

Now, when you think something is a fraud one of the first things you do is head over to Snopes.com to see if that crew had rendered a verdict. Indeed, the Snopes team is flying a "True" flag. This citizen wanted to send a message to the world.

Thus, I mentioned this instantly viral obituary during this week's "Crossroads" podcast discussing the whole "lesser of two evils" conflict that many cultural and religious conservatives are experiencing during this election year. Click here to tune that in and we'll come back to my Universal "On Religion" column on that topic.

But here is the top of the obituary in question. When host Todd Wilken and I were discussing this on the air, I just couldn't get my self to use the woman's name. Why? Well, because the first couple of people I discussed this with -- face to face -- kind of turned pale and asked if suicide was involved. The answer is "no."
