Religion vs. history? Something's missing in coverage of that banned Ten Commandments monument in Oklahoma

Here in my home state of Oklahoma, the Ten Commandments made headlines this week.

More precisely, a monument to the "Thou shalts" and "Thou shalt nots" sparked a 7-2 decision by the state Supreme Court.

The lede from The Oklahoman:

The Ten Commandments monument must be removed from the grounds of the state Capitol, the Oklahoma Supreme Court ruled Tuesday.
Justices ruled 7-2 the monument must go because the state constitution prohibits the use of public property to directly or indirectly benefit a “church denomination or system of religion.”
The decision touched off a furor at the Capitol with several lawmakers calling for impeachment of the seven justices who voted in the majority.
Attorney General Scott Pruitt said he believes the court "got it wrong" and filed a petition for rehearing — a move that will at least delay removal of the monument.
If that fails, Pruitt called for changing the state constitution.
Not everyone was unhappy, however.
Brady Henderson, legal director of the American Civil Liberties Union of Oklahoma, which filed the lawsuit, said he was "very pleased with the decision."
"I think it's the right decision and affirms the plain meaning of the state Constitution which has always stood for the idea that it isn't the government's business to tell us what are right or wrong choices when it comes to faith,” he said.

Yo, journalists: There are real church-state issues linked to the Church of Cannabis

Journalists who took the time to dig into the history of the Religious Freedom Restoration Act -- all the way back into ancient times, as in the Clinton White House -- will have run into references to a 1990 U.S. Supreme Court case called Employment Division v. Smith.

That case focused on this question: Did Native Americans -- in this case workers at a private drug rehabilitation group -- have the right to take peyote as part of a religious ritual linked to similar rites in their heritage dating back centuries? The conservative side of the court said "no," while liberals dissented and said the decision denied Native Americans the free exercise of their religious beliefs.

Justice Antonin Scalia famously said that this kind of religious liberty appeal would "open the prospect of constitutionally required exemptions from civic obligations of almost every conceivable kind."

A nearly unanimous U.S. Congress begged to differ and passed RFRA, backed by a stunningly broad church-state coalition -- basically everyone from Pat Robertson to the American Civil Liberties Union. It was a law inspired by some strange and messy legal cases, but as my graduate-school mentor at Baylor University's Church-State Studies program used to say: Your religious liberty has been purchased for you by people with whom you might not want to have dinner.

In other words, the First Amendment's "free exercise" clause is very powerful and, unless you are dealing with fraud, profit or a clear threat to life and health, courts are not supposed to mess with religious doctrines and practice, even when dealing with messy cases.

Why do Mississippians oppose same-sex marriage? Los Angeles Times editors know, for sure

On one level, the new Lost Angeles Times news story about the status of same-sex marriage in Mississippi is quite interesting, in light of the current Kellerism state of affairs in American journalism in the wake of the 5-4 U.S. Supreme Court decision legalizing same-sex marriage.

The story does offer quite a bit of space for leaders of the American Family Association, which is based in the state, to voice their viewpoints on the case. Then again, the Times team seems to assume that the AFA is the perfect, if not the only, example of an organization in that state to oppose the decision.

What are preachers in black churches in the state saying? What about the local Catholic hierarchy? How about the Assemblies of God? Does any other religious group -- black, white, Latino, etc. -- back the decision by Mississippi's attorney general, Jim Hood, to reject the high court's ruling?

However, it appears that the AFA was the perfect conservative voice to balance the following remarkable passage -- which was offered as unchallenged, unattributed, factual content in a hard-news report, as opposed to being in an editorial column or an analysis essay.

So, what is this?

To understand Mississippi's resistance to gay marriage, it helps to look at its legacy as a deeply religious and conservative state. This is where three civil rights workers were killed by the Ku Klux Klan in the 1960s; where James Meredith became the first black student to enroll in Ole Miss, but only after a violent confrontation; and where the Confederate symbol is still part of the official state flag.
It is where 59% of residents described themselves as “very religious” in a 2014 Gallup Poll, higher than any other state, and where 86% of voters in 2004 approved a ban on same-sex marriage.

That was really subtle.

Hey New York Times: Is North Carolina law really about 'curtailing same-sex unions,' or is religious freedom the issue?

The New York Times reports that North Carolina lawmakers passed a measure Thursday "aimed at curtailing same-sex unions."

Here's my pesky question for the Times: Can you provide any facts — any facts at all — to back up that claim?

Or is this new state law — as the supporters claim — about protecting religious freedom?

To give a little background, you'll recall that the Times previously ventured down to North Carolina and provided mediocre coverage on what it labeled "so-called religious freedom bills."

This is the lede on the latest story:

DURHAM, N.C. — Defying the governor, lawmakers on Thursday enacted a law that allows state court officials to refuse to perform a marriage if they have a “sincerely held religious objection,” a measure aimed at curtailing same-sex unions.

Concerning a head scarf in Tulsa and yet another sighting of an old church-state coalition

Through the years, your GetReligionistas have made quite a few references (like this one, for example) to a remarkable period of time in American church-state history when a strong, diverse coalition stood together on religious liberty (no scare quotes) issues. This coalition ranged from Pat Robertson over to the Unitarians, with the Baptist Joint Committee somewhere in the middle.

It was a remarkable time for First Amendment liberalism, as classically defined. After all, it would be hard to call the Clinton White House right wing. This coalition stood together in the development of equal access rules protecting religious expression in the public square and, earlier, in the famous case protecting the rights of neo-Nazis to march through a Chicago suburb that included many Holocaust survivors. The coalition stood united -- supporting religious freedom at the global level -- to back the International Religious Freedom Act of 1998.

Some journalists (hurrah!) even noted this at the time, every now and then. Here is a sighting of this coalition, in a 1993 New York Times story about the slam-dunk passage of the Religious Freedom Restoration Act:

President Clinton hailed the new law at the signing ceremony, saying that it held government "to a very high level of proof before it interferes with someone's free exercise of religion." ...
His sentiments were echoed by many other members of an unusual coalition of liberal, conservative and religious groups that had pressed for the new law. The coalition included the National Association of Evangelicals, the Southern Baptist Convention, the National Council of Churches, the American Jewish Congress, the National Conference of Catholic Bishops, the Mormon Church, the Traditional Values Coalition and the American Civil Liberties Union.

This brings us to the recent 8-1 U.S. Supreme Court decision involving a 17-year-old Muslim in Tulsa, Okla., who was rejected for a job at Abercrombie & Fitch because of her head scarf. Read this piece of The Los Angeles Times coverage carefully:

The court’s liberal justices have long championed religious minorities in discrimination cases. But as Christian conservatives have more frequently found themselves on the defensive over issues such as abortion and gay rights, the court’s conservatives have also embraced claims of religious liberty.
Last year, a conservative majority ruled that the religious owners of the Hobby Lobby chain of craft stores did not have to comply with a government mandate to offer certain birth control methods as part of the company’s health plan.

How quickly will journalists grant O'Malley that 'Pope Francis Democrat' label?

If Martin O'Malley hired an army of public-relations pros he could not have produced a better White House campaign slogan than the one offered by Religion News service the other day in an online headline about the former Maryland governor. This short news-you-can-use feature was part of its ongoing series offering background on the religious views of various candidates. It proclaimed:

5 faith facts about Martin O’Malley: ‘A Pope Francis Democrat’

Some folks in pews on the cultural and doctrinal right may want to contrast the tone of that with this selection from another RNS digital newsletter:

Billings, Mont., Gazette needs to pose more questions about dinosaur museum imbroglio

There’s a lot of religion out in America’s rural precincts, far from the big news zip codes that really matter, but sometimes it's hard to get decent coverage.

Here’s a piece about public school children in northeast Montana who’ve had an annual field trip for several years to a museum that espouses a creationist perspective. Then someone anonymously complains -- apparently not to the school itself but to an out-of-state group that has the legal chops to make things unpleasant if it so wants to -- and said group threatens the local school district. Judging from the tone of this piece, the local reporter is not familiar with Americans United for Separation of Church and State but those of us who’ve covered religion out of Washington DC know them quite well. They have a nice suite of offices on Capitol Hill and they can be intimidating.

Here’s what happened:

Glendive third-graders will no longer visit their town's creationist museum amid concerns that the annual school trip to learn about dinosaurs violates the constitutional separation of church and state.
School district administrators had authorized this year's field trip to the Glendive Dinosaur and Fossil Museum but reversed course last week after receiving a letter from a Washington, D.C., advocacy group calling the school-sponsored event illegal. Their decision dashed the hopes of many of the children, some parents said.

Christ and Russia: Newsweek offers only a partial picture of a religious trend

"Russian Communists are turning to Christ," Newsweek trumpets, as if the magazine has discovered the wheel. It's almost old enough to deserve one of our "Got News?" logos.

Almost. The article does have a few things going for it -- starting with the first three strong paragraphs:

What do Vladimir Lenin, founder of the officially atheist Soviet Union, and Jesus Christ have in common? Not much, one would think. Yet according to Gennady Zyuganov, the veteran leader of Russia's modern-day Communist Party, both men sought to "save humanity" with a message of "love, friendship, and brotherhood".
Speaking in Moscow in front of a crowd of red-flag-waving supporters on the 145th anniversary of Lenin's birth late last month, Zyuganov also declared that the Soviet Union was an attempt to establish "God's Kingdom on Earth".
Had he heard that speech, Lenin would likely have turned over in the Red Square mausoleum, where his embalmed corpse has been on public display for the past 91 years. After all, some 200,000 members of the clergy were murdered during the first two decades of the Soviet era, according to a 1995 Kremlin committee report, while millions of other Christians were persecuted for their faith.

The story then traces reactions to Zyuganov's recent speech in Red Square. Some critics "pointed out the apparent contradictions inherent in his mingling of communist and Christian beliefs." Other critics regard Zyuganov's  talk a "cynical ploy" to gain support from party members and Eastern Orthodox Christians alike. And Newsweek itself says he is a "former Soviet 'agitation and propaganda' official."

Newsweek then reports some intriguing cross-fertilization between church and state. It says Russian President Vladimir Putin tries to portray himself as a defender of "Orthodox Christian values." It notes that a priest singing a "popular Soviet-era song" went viral. And it says church motifs have often served the state, such as religious icons of Josef Stalin -- and the decision to embalm Lenin's body for a mausoleum in Red Square.

Concerning RNS and GetReligion: Yes, there are 'church' and 'state' debates in journalism

For weeks, I have been hearing from readers asking me when GetReligion was going to address the Catholic News Agency report about the $120,000 grant from the Arcus Foundation to the Religion Newswriters Foundation, which owns Religion News Service.

In one article, CNA noted that the grant listing said that its purpose was to "recruit and equip LGBT supportive leaders and advocates to counter rejection and antagonism within traditionally conservative Christian churches." When announcing the grant, Arcus officials said this grant would help foster a "culture of LGBT understanding through the media” by funding news reports and blogging posts “about religion and LGBT peoples of color.”

RNS Editor Kevin Eckstrom defended his wire service's editorial independence, stressing that this public relations represented "Arcus’ description of their funding, not ours.” It is also crucial to note that the funding connections between RNS and the Religion Newswriters Foundation are complex, to the degree that CNA needed to correct some fine details. Please read that whole report carefully.

In that story, Eckstrom also noted that GetReligion frequently criticizes RNS because its work does not meet our blog's "standard of theological orthodoxy.”

I did not respond, although there is much to be said on these matters. First of all, please note that GetReligion frequently praises the work of RNS and we certainly recognize its crucial role as the only mainstream news operation dedicated to covering the religion beat. Second, let me acknowledge that -- over the past decade -- RNS frequently took interns from the Washington Journalism Center (which is now being rebooted in New York City). Eckstrom and his team, frankly, did a fantastic and gracious job working with my program's students and I will always be grateful for that.

So what can I say about the "theological" issues involved in this discussion? Let's start with some background on journalism "theology."
