Many journalists quick to slam religious freedom for doctors -- for all the wrong reasons

Sometimes I wish so many  journalists weren’t so predictable.

The announcement for the new Conscience and Religious Freedom Division in the Department of Health and Human Services was barely 24 hours old when a bunch of articles rained down promising everything from massive discrimination against gays to something close to A Handmaid’s Tale.  

The majority of the articles were so focused on the possibility of LGBTQ fallout from this new division that the reporters missed one of the real targets: Planned Parenthood. This Christianity Today article explains why Planned Parenthood is the real victim, as it were, of this HHS development. 

Instead, you have everything from Slate calling the division “organized, insidious form of bigotry” to NBC News saying the new conscience protections puts the rights of providers over that of patients

Here’s how the New York Times explained it:

WASHINGTON -- The Trump administration announced on Thursday that it was expanding religious freedom protections for doctors, nurses and other health care workers who object to performing procedures like abortion and gender reassignment surgery, satisfying religious conservatives who have pushed for legal sanctuary from the federal government…
For religious conservatives, the new protections address long-held concerns that religious people could be forced to comply with laws and regulations that violate their religious beliefs. Roger Severino, the director of the office for civil rights at the Department of Health and Human Services, promised that he and his staff would investigate every complaint of a violation of “conscience rights” protected by federal law.
But civil rights, gay rights and abortion rights groups, as well as some medical organizations, expressed alarm at a move they described as part of a systematic effort by the Trump administration to legitimize discrimination.

First do no harm: People, as well as politics, are crucial when covering medical conscience fights

It's one of the most famous phrases in the world of medical ethics: "primum non nocere." That's Latin, of course. It means, "First do no harm."

Ah, but who gets to make the ultimate decision about whether a particular medical procedure or strategy for care will do harm to a patient? Is that ethical/moral call up to the patient, the doctor, the doctor's boss, an insurance company or even lawyers representing the U.S. government?

Now flip that question around. What if doctors pledged something like this: "First, do good." Who gets to decide what is good? Clearly, there are legal, ethical and, yes, religious questions linked to these decisions and that has been the case for centuries.

So let's pull these ancient questions and values into our litigious age.

A patient requests an abortion, perhaps even in the second or third trimester. The doctor (or perhaps a nurse) is an orthodox Catholic, a Mormon, a traditional Muslim, an Eastern Orthodox Christian, an Orthodox Jew or someone else with a deep and consistent belief that it would be wrong, a mortal sin even, to take part in this procedure. Some questions linked to medical care for trans patients, especially children, would create a similar ethical/theological crisis. Doctors do not agree on what causes "harm." Many disagree on what is "good."

How do reporters cover stories linked to these debates? First, do no journalistic harm?

Hold that thought. Here is the top of a Washington Post feature -- from the national desk, not the religion team -- on this semi-new front in America's culture wars.

The Trump administration will create a new conscience and religious freedom division within the Health and Human Services Department to ease the way for doctors, nurses and other medical professionals to opt out of providing services that violate their moral or religious beliefs.

Why no news coverage of Trump silence on China's destruction of evangelical megachurch?

One reason elements of the Christian Right are said to strongly back President Donald Trump is because of their, and supposedly his, deep concern for global religious freedom issues -- in particular the persecution of Christians in nations such as China.

Yet, as of this writing (Jan. 15), the White House has yet to utter a peep about last week’s destruction by the Chinese government of a massive “underground” evangelical church facility that housed a huge congregation of 50,000 or more, according to reports.

Moreover, no one in the mainstream or Christian media, as far as I can ascertain, has publicly asked the administration for an answer as to why it has remained mute. Not Trump’s media supporters or opponents (of which I am one).

Nor have we heard anything from members of the president's personal religious advisory committee. And certainly not from anyone from the State Department or the largely punchless United States Commission on International Religious Freedom -- which did see fit to issue a statement last week marking the death of Mormon Church leader Thomas S. Monson.

Has the Trump coverage bar dropped so low, has it been so overwhelmed by endless questions about crises seemingly of the president’s own making, that there simply is no room left for routine questions as to why the administration failed to issue so much as a pro forma response to the church demolition?

Clearly, I'm afraid, the answer is “yes.”

But that doesn't mean that religion-beat writers, in particular, should simply acquiesce to the current state of affairs.

The almost ambassador: The Gray Lady slams Brownback for not leaving his Kansas job

Some of you may remember how, in late July, Kansas Gov. Sam Brownback was appointed to a U.S. State Department post that champions religious freedom.

Five months later, he’s still in Kansas.

On Monday, the White House renominated him for the post after Democrats refused to allow his -– and other failed nominations -– to roll over into the New Year. The White House’s action also gave politicians a wake-up call that this is an issue the Trump administration cares about.

Weirdly, a New York Times story blamed the governor for the impasse.

TOPEKA, Kan. -- Gov. Sam Brownback of Kansas was giving a tender goodbye.
Speaking to a roomful of fellow Republicans over lunch at the Wichita Pachyderm Club last month, he mused about his next act, a post in the Trump administration as ambassador at large for international religious freedom, which was announced in July.
“As I pass from the stage here in Kansas, I leave with a warm thought and good feelings of all the good-hearted people in this wonderful state of Kansas,” said a smiling Mr. Brownback, whose seven years at the helm have been punctuated by a firm turn to the right and a revolt from some in his own party.

The governor had a replacement: Lt. Gov. Jeff Colyer, a plastic surgeon.

It has been nearly six months since Mr. Brownback, 61, announced that he would be leaving for a new job during his second term as governor. The holdup appears to be in Washington: A Senate committee held a hearing on his nomination and narrowly endorsed him in October, but he did not receive a vote in the full Senate.
A new year has brought new complications. Though Mr. Brownback has been renominated to the post, a relatively low-profile appointment, he will still have to be confirmed by the Senate. 

The story goes on to talk about how awkward things are in Kansas because Brownback is like the perennial guest who won’t leave. It mentions a Kansas City Star editorial that tells Brownback he should resign for the good of the state, even though it doesn’t say how the governor is supposed to pay his bills during the interim.

Here we go again: When covering campus LGBTQ disputes, always look for doctrinal covenants

It is, without a doubt, the question that I hear most often when I have a chance to meet -- face to face -- with GetReligion readers. It's one of the questions I keep seeing in reader emails.

This question: Do we ever get tired of having to address the same journalism issues over and over, writing posts that include links back to previous posts, which then link back to earlier posts and on and on?

That's right: Same as it ever was. It's kind of a deja vu all over again thing.

Yes, we do get rather tired of doing this. However, we keep hoping that at some point journalists will, you know, take an interest in basic facts about how religious institutions -- on the left and right -- do their work as voluntary associations. Why avoid relevant doctrinal and even legal information in stories about controversial issues?

So, before we get to the Inside Higher Ed coverage of the North Park University campus minister who was suspended after performing a same-sex marriage rite, let's do that flashback think that we have to do every now and then. The headline on this earlier post: "Oh no, not again: AP fails to ask school 'covenant' question in LGBTQ teacher case." Here is the echo-chamber overture:

I know. I know. Trust me, I know that your GetReligionistas keep making the same point over and over when digging into mainstream news coverage of LGBTQ teachers (or people in other staff positions) who, after making public declarations of their beliefs on sex and marriage, lose their jobs in doctrinally defined private schools.
We keep making the point over and over because it's a crucial question when covering these stories. When are reporters and editors going to start asking the crucial question?
The question, of course, is this: Had the person who was fired voluntarily signed an employee lifestyle (or doctrinal) covenant in which they promised to support (or at least not openly oppose) the teachings at the heart of the religious school's work?

That brings us to the Rev. Judy Peterson at North Park and this headline: "Gay Wedding Costs College Pastor Her Job."

One side of Sweetcakes by Melissa case remains unreported. Who will cover this story?

I know we’ve been running a lot about bakers of wedding cakes, gay customers and court cases, but I wanted to draw your attention to a related case I've written about that’s been dragging through Oregon’s legal system for the past few years.

It’s the “Sweet Cakes by Melissa” case that began when a chance comment from a baker infuriated two lesbians to where they filed a lawsuit alleging all sorts of emotional harm. Oregon’s labor commissioner, who’s never hid his LGBTQ-friendly sentiments, slammed the bakers with a $135,000 fine that the defendants are still fighting to this day.

It’s become a running sore of a case to both sides of the argument. After the Oregonian ran the latest news on an appeals court verdict, there were 4,413 comments attached to it by the time I saw the piece several days later. Obviously there’s lots of strong feelings about this case on both sides.

The Oregon Court of Appeals on Thursday upheld a decision by Oregon's labor commissioner that forced two Gresham bakers to pay $135,000 to a lesbian couple for whom the bakers refused to make a wedding cake.
Melissa and Aaron Klein made national headlines in 2013 when they refused to bake a cake for Rachel and Laurel Bowman-Cryer, citing their Christian beliefs. The Bowman-Cryers complained to the Oregon Bureau of Labor and Industries, saying they had been refused service because of their sexual orientation.
An administrative law judge ruled that the Kleins' bakery, Sweetcakes by Melissa, violated a law that bans discrimination based on sexual orientation in places that serve the public. Brad Avakian, the state labor commissioner, affirmed heavy damages against the Kleins for the Bowman-Cryer's emotional and mental distress.

The Oregonian knew all about the latter, as it had run a nearly 4,300-word piece in August 2016 about the two women with the headline: “The hate keeps coming: The pain lingers for lesbian couple denied in Sweet Cakes case.” It went into great detail. 

But why wasn’t there similar treatment accorded the Kleins?

Happy New Year!

As we plunge into 2018, I'm excited about another year of writing for GetReligion. At this journalism-focused website, we highlight both positive and negative examples of mainstream reporting on religion news. 

I write four posts a week (including the all-new "Friday Five"). That adds up to 200 times a year that I offer my insights and opinions. Some of my posts go viral on social media. Others, um, do not. 

These were my 10 most-clicked posts of 2017:

Wrapping up 2017: The Atlantic looks at big religion themes in Trump's foreign policy

As always, the GetReligion team slows down a bit during the Holiday season (broadly defined).

We don't vanish. We don't stop reading or paying attention to our email. But we do have other things to do, like travel and welcoming guests (and in my case, celebrating a 40th wedding anniversary).

One thing we will be doing in the next week or so is noting some of the interesting 2017 yearender features focusing on religion-news events and trends. I don't know if we will do another "Parade of Yearenders" like last year, but we'll give you a few things to read.

We have already started in recent weeks. If you haven't tried one of our "Crossroads" podcasts, click here and give this one a try -- "Looking at top stories of 2017: Sometimes it seems like religion haunts everything." That post includes this years Top 10 stories from the Religion News Association, as well as my own take on the year's events in an "On Religion" column for the Universal syndicate. Bobby Ross, Jr., also pointed to the RNA poll here.

It has, so far, been easy to spot a trend among the yearenders. Rather than doing lists of the major events, more and more journalists are producing lists of the top stories at their own websites (the kind of thing GetReligion does on this website's anniversary every year). That's interesting, and valid, but I always enjoyed contrasting the Top 10 news lists.

In other words: Hint, hint. Please send us URLS you spot for yearender pieces and the newsier the better. Top 10 lists? Yes, please.

It would be impossible to sum up the religion-news coverage in the year without mentioning the work of Emma Green at The Atlantic. While her work is written in an analysis style suited to magazine features, during 2017 she often focused on important religion-news topics -- especially church-state conflicts -- before hard-news operations took them on. Here's how I described that process back in September:

Not really new news: Immigration has affected churches in Canada (and elsewhere) for years

"There is no new thing under the sun," the writer of Ecclesiastes tells us in chapter 1, verse 9. While it's doubtful that said author was also a newspaper editor, it's a handy point for editors to remember, I believe. Too little of what is reported as "news" is, actually, "new."

These thoughts came to mind as I read a story in the Globe and Mail, Toronto's flagship paper whose reporters cover the whole of Canada as well as the rest of the world. "Immigrants providing a boost to declining church attendance in Canada," the headline reads.

Take a look at this longish excerpt to get a flavor of the piece:

Eli Wu brought his wife and teenaged son to Vancouver this past summer, emigrating from China in search of a better education for his child. He wasn't searching for God, but after arriving in Canada he found himself drawn in an unexpected direction.
In China, he said he didn't pay too much attention to Christianity, although some of his family members attended church. Organized religion was prohibited in China during the Cultural Revolution, but there was a revival of Christianity at the beginning of 1980s, when the government lifted restrictions on religion. Still, the Chinese government maintains some control over worship.
"In China, [things like] getting baptized and accepting legitimate Christianity are controlled by the government," Mr. Wu said. "When the gospel is discussed in China, because of some political factors, it cannot be [considered] too real."
The decline in the number of Canadians identifying as Christian is a well-documented and persistent trend. But among the people who will file into the pews for Christmas services are a growing number of immigrants, many of whom have converted to Christianity after arriving here, often from China.
New congregants such as international students come because church offers them support and community and an escape from loneliness. Others, like Mr. Wu and his son, come after experiencing Canada's religious freedom.

Here's the journalism problem: The fact of churches welcoming and accommodating immigrant populations is nothing new.
