Unfinished 2019 business in America's ongoing First Amendment wars over religious liberty

During the year-end news rush, many or most media – and The Religion Guy as well – missed a significant development in the ongoing religious liberty wars that will be playing out in 2019 and well beyond. 

 On Dec. 10, Business Leaders in Christ filed a federal lawsuit against the University of Iowa for removing the group’s on-campus recognition on grounds of discrimination on the basis of sexual orientation.  This club for business students requires its leaders to uphold traditional Christian beliefs, including that “God’s intention for a sexual relationship is to be between a husband and wife.” See local coverage here.

These sorts of disputes across the nation are thought to be a factor in religious citizens’ support for Donald Trump’s surprise election as president. And the Iowa matter is a significant test case because the Trump Department of Justice filed in support of the club Dec. 21, in line with a 2017 religious liberty policy issued by former Attorney General Jeff Sessions. 

The DoJ’s court brief is a forthright presentation of the argument the Iowa club and other such organizations make for freedom of association, freedom of speech and “free exercise of religion” under the Constitution. More broadly, what does the American nation believe these days regarding religious freedom?

That’s the theme of a related and also neglected story, the Nov. 29 issuance of a new “American Charter of Freedom of Religion and Conscience” (info and text here). The years-long negotiations on this text were sponsored by the Religious Freedom Institute, which evolved from a Georgetown University initiative, and Baylor University’s Institute for Studies of Religion. 

The Religion Guy finds this document important, although at 5,000 words needlessly repetitive.  In essence, it asserts that freedom of religiously grounded thought, observance and public action, and the equal rights of conscience for non-believers, are fundamental to the American heritage and the well-being of all societies. 

Adopting lingo from federal court rulings, the charter says these freedoms are not absolute. But any “substantial burden” limiting them “must be justified by a compelling governmental interest” and implemented by “the least restrictive” means possible. The charter also endorses the separation of religion and state.

It is remarkable — and discouraging to The Guy — that basic Bill of Rights tenets even need to be reiterated in this dramatic fashion, because that tells us they are too often neglected -- or rejected.  

The charter has won a notably varied list of initial endorsers because it purposely avoids taking stands on the “sometimes bitter debates” over how to apply these principles, in particular clashes between religious traditionalists and the LGBTQ community.

NPR could have asked: What should evangelicals say about a president caught in adultery?

Every journalist knows this essential truth: It’s very easy to report and write a story that you have already reported and written in your mind — even before you make the first phone call to the first source.

During the week leading up to Christmas, I was bracing myself for one of those stories, focusing — #DUH — on Donald Trump and all of those white evangelicals in Middle America who, in most media coverage, worship the ground on which he walks.

As it turned out, that’s the kind of story that showed up in the spectacular scandal at Der Spiegel, where editors had to face the fact that superstar reporter Claas Relotius had been making up lots of the material reported in his feature stories — including a piece about Trump supporters in the American heartland.

In my post about that media storm, I wrote the following:

The key is that one of the most celebrated newsrooms in Europe decided to probe the dark heart of Middle America in the age of Donald Trump. You know: How do solid, faithful, ordinary Americans in the heartland make peace with their support for a demon? That sort of thing.

Frankly, I have been bracing myself for exactly this kind of feature during the Christmas season, a kind of 'It’s Christmas in Donald Trump’s America' vision of life in some heavily evangelical Protestant town in the Bible Belt.

Well, that hasn’t happened. Yet.

To which, a longtime GetReligion responded: “How about this one, courtesy of NPR?”

Well, the story in question isn’t a Christmas piece. It’s an end-of-the-year feature with this headline: “For Evangelicals, A Year Of Reckoning On Sexual Sin And Support For Donald Trump.” But, as we would say in Texas, it’s close enough for horseshoes and hand grenades.

As always, this NPR story featured the following piece information:

About 80 percent of white evangelical voters backed Trump in 2016, and exit polls from this year's mid-term election showed little or no erosion of that support.

As always, I would have preferred, for the sake of nuance and accuracy, that this sentence have said that these evangelicals “voted for” Trump in 2016, rather than “backed” — since many actually opposed his candidacy and reluctantly voted for him as a painful way to defeat Hillary Clinton. But the simple fact of the matter is that this NPR piece pushes lots of valid buttons, using a mix of sources — such as evangelicals and, if would appear, former evangelicals. Here is the overture:

Merry Christmas to media critics: Elite German reporter visits American heartland and ....

The following post doesn’t have anything to do with Christmas.

Well, wait. I can imagine that there are conservative critics of the mainstream press — especially in its most elite forms — who would see the following headline as a kind of Christmas present. And later on in this post, there will be a religion-and-politics angle to this scandal. So hold that thought.

But let’s start with the end of tale, care of this NBC News headline: “German reporter stripped of CNN 'Journalist of the Year' awards for fabricating stories.”

Hey fans of great journalism movies: We are talking about a kind of sequel to “Shattered Glass,” only with a reporter who was working for an elite news publication — Der Spiegel — as opposed to a liberal journal of editorial opinion, commentary and news. Here’s the top of that Associated Press, as featured by NBC News:

BERLIN — A German journalist who was found to have fabricated numerous articles is being stripped of two awards he received in 2014 from CNN International, the broadcaster said Thursday.

In a statement to The Associated Press, CNN International said the independent panel of judges who awarded Claas Relotius the Journalist of the Year and Print Journalist of the Year awards four years ago decided unanimously to remove them following revelations about his fraud.

German magazine Der Spiegel, where Relotius worked as a freelancer and later full-time, said Wednesday that he had fabricated interviews and facts in at least 14 articles.

The publication, one of Germany's leading news outlets, said the 33-year-old had committed journalistic fraud "on a grand scale" over a number of years, including fabricating elements of an article about an American woman who he said volunteered to witness the executions of death row inmates.

Now it’s time for the flashback to a feature at Medium that got lots and lots of attention — in America and, perhaps, in Germany. The headline: “Der Spiegel journalist messed with the wrong small town.”

Call the police: Baby Jesus has been stolen — and The New York Times has a compelling story about it

I’m in Texas at my Mom and Dad’s house as I type this — about to enjoy a festive Christmas Eve breakfast with chocolate syrup and pancakes, white gravy and biscuits, sausage, bacon and assorted other fixings.

My wife, two of my children, my brother, sister, my sister-in-law and various nephews and a niece will join me in line as we start our Christmas celebration by eating way too much.

I mention the above mainly because it’s all I can think about at the moment, but also because it may help explain why this post will be pretty quick and to the point.

I’ve got somewhere else to be, don’t you know.

Seriously, I want to highlight two New York Times stories real briefly this morning — both about nativity scenes, but one a much more compelling read than the other.

The first story was featured on Sunday’s front page with the headline “Cameras, Bolts and an Elusive Goal: To Sleep in Heavenly Peace.”

It’s a creative, timely piece about a national trend of baby Jesus being swiped from Nativity scenes nationally, and the dateline — the setting for the story — is pure brilliance:

BETHLEHEM, Pa. — Away in a manger on Bethlehem’s public square, a woman approached a statue of the baby Jesus one dark, December night. Then she stole it.

The theft, from a Nativity scene outside City Hall, raised alarm in this eastern Pennsylvania city that shares a name with the real Jesus Christ’s birthplace.

When the missing baby Jesus was found, it had been damaged, and Bethlehem’s police chief had to glue its leg back on. Then the city took action, positioning a concealed security camera exclusively on baby Jesus and assigning police officers to monitor the footage. In the two years since, the statue has been left at peace, asleep on the hay as the camera, nicknamed the “Jesus cam” by some residents, rolls.

“If anybody looks real close, they’ll see a crack in his leg,” said Lynn Cunningham, a leader of the local chamber of commerce.

Such manger larceny, in glaring violation of the Eighth Commandment, is also part of a sad national trend. This year, thieves have raided Nativity scenes in Tennessee, West Virginia, Minnesota and plenty of other places, and made off with Jesus figurines (and sometimes Mary and a donkey, too).

In terms of clever writing, there are nice touches throughout. As for religion, the reporter doesn’t neglect it, including lines such as this:

Child sexual abuse by priests was top 2018 religion story: What about McCarrick and the bishops?

On July 16, the New York Times ran a blockbuster story with this headline: “He Preyed on Men Who Wanted to Be Priests. Then He Became a Cardinal.

The man at the heart of this story was Cardinal Theodore McCarrick — now ex-cardinal — long one of the most powerful Catholics in America and, some would say, the world. His spectacular fall led to a tsunami of chatter among religion-beat veterans because of decades of rumors about his private affairs, including beach-house sexual harassment and abuse of seminarians. There was another layer to all of this. McCarrick’s career was rooted in work in the greater New York City area and in Washington, D.C. He was one of the most important media sources among center-left Catholic leaders, so much so that a cluster of reporters linked to him became known as “Team Ted.”

Then came the brutal letters from the Vatican’s former U.S. ambassador, Archbishop Carlo Maria Vigano, claiming that a global network of Catholic powerbrokers — including Pope Francis — had helped hide McCarrick and had profited from his clout and patronage.

In August there was an explosion of news about the release of a hellish seven-decade grand-jury report about abuse in six dioceses in Pennsylvania.

The bottom line: 2018 was a year in which there were major developments in two big clergy sexual abuse scandals in the Catholic world. They were, of course, connected.

There was the old, ongoing story of priests abusing teens and children, starting with headlines in the early 1980s. Then there was the issue of how to discipline bishops, archbishops and even cardinals accused of abuse — a story in which all roads lead to Rome and, these days, Pope Francis.

Which story was more important in 2018? Which story centered on new, global developments? These questions are at the heart of this week’s “Crossroads” podcast. Click here to tune that in.

Our discussion centered on the release of the Religion News Association’s annual list of the Top 10 religion-beat stories — in which the Pennsylvania grand-jury report was No. 1 and McCarrick and Vigano fell near the end of that list.

In my own list, McCarrick and Vigano were No. 1 and the Pennsylvania report was No. 4, in part because 97 percent of its crimes were pre-2002, the year U.S. bishops passed strict anti-abuse policies.

There was another strange — IMHO — twist in this. RNA members selected Episcopal Church Presiding Bishop Michael Curry as Newsmaker of the Year, after his long, progressive sermon at the royal wedding of Prince Harry and Meghan Markle. Oddly, McCarrick’s name was not even included on the ballot.

Friday Five: New NYT religion writer, Illinois priest abusers, suicide homily, Godbeat on YouTube

In case you missed it on social media, there’s big news this week concerning the Godbeat at The New York Times.

Laurie Goodstein, who since 1997 has — as a newsroom press release put it — “owned the religion beat at The Times, covering it with smarts, passion and a commitment to accountability and understanding,” is taking on a new role. She’ll become a deputy international editor.

The name of Goodstein’s successor will be familiar to regular GetReligion readers: It’s Elizabeth Dias, whose stories we have praised often.

My first reaction to that news was, “Isn’t Dias already a Times religion writer?” But actually, her previous title was faith and values correspondent, focused on the religion angle of politics.

Attention all newsroom managers: There will also be non-political news in 2019  

We already know that in 2019 the news biz will be as consumed by All Things Trump as during the prior three and a half years. The media must also monitor countless maneuvers by countless Democratic presidential hopefuls. And there will be those ongoing eruptions in global politics.

If any column inches and air time are left over for our beat, the temptation will be to do those “religion and” stories, oh you know like predictable Donald Trump accolades from the media’s favorite evangelicals. On the big 2019 theme of whether the President can win a second term, The Guy reminds pundits for the umpteenth time that white Catholics outside the  Bible Belt will decide that.  

Most important, The Guy advises editors that audiences will welcome a bit of a break from political news. How about covering the more religious aspects of the religion beat like these three major 2019 stories?  

First, the top story of 2018, as the Dec. 5 Guy Memo proposed, is reports that the “CRISR” technique in November successfully produced the first newborns with engineered genes that  will be inherited by future generations. Biologists “playing God” to create human “designer babies” is an ethical quagmire that demands 2019 folo-ups.

Then, two vital and nearly simultaneous church events, one dealing with moral performance and the other with moral doctrine, will reverberate throughout the year.

Ready to mark those calendars?

Feb. 21-24 — Pope Francis has summoned the 135 heads of national  bishops’ conferences and comparable officers for a Vatican summit to cope with the disgusting and ceaseless cascade of priests who sexually molested underaged boys and girls (and the bishops and cardinals who hid them). The stakes could not be higher for the world’s 1.3 billion Catholics.

This brings fierce memories of Pope John Paul II’s 2002 Vatican abuse confab with U.S. Catholic leaders (which The Guy covered for The AP alongside Rome Bureau legend Victor Simpson). Shortly thereafter, several hundred reporters (including The Guy alongside award-winning AP virtuoso Rachel Zoll) swamped the U.S. bishops’ meeting in Dallas that devised a cleanup plan.  

U.S. scandals then dominated the news. Since, it’s become obvious this is no “American crisis” but a worldwide one. The fact that victims’ suffering, scandals, cover-ups, malfeasance, investigations, lawsuits and bankruptcies persist 16 years later shows how intractable the moral rot has proven to be, with Cardinal Pell’s conviction the latest instance.

It's hard to cover bitter tensions in Kiev, Moscow and Constantinople while ignoring church history

It is hard to evaluate the journalistic quality of a New York Times report about a complicated, emotional religious dispute with 1,000 years worth of history when the report — when push comes to shove — is a one-sided look at its contemporary political implications.

Once again, politics trumps church history and doctrine. Surprised?

I am referring to the clash in Ukraine between Orthodox Christians who back centuries of ecclessiastical ties between Kiev and Moscow and those who support the bid by President Petro O. Poroshenko, with the backing of Ecumenical Patriarch Bartholomew, to create an independent, canonical Ukrainian church. Here’s the overture for the recent report in the Times:

MOSCOW — Ukraine took a major step on Saturday toward establishing its own, autonomous Orthodox Church, setting the stage for increased tensions with Russia by altering a centuries-old religious tradition under which the Kiev church answered to Moscow.

Some 190 bishops, priests and other church figures spent the day closeted in St. Sophia’s Cathedral in downtown Kiev to elect the newly unified Ukrainian church’s head, Metropolitan Epiphanius. He is scheduled to travel in January to Istanbul, the historical seat of the Eastern Orthodox Church, to receive an official order granting autonomy.

Hundreds of supporters of the move cheered and some wept as President Petro O. Poroshenko, who had attended the session, emerged from the cathedral to announce that Ukraine had a new church leader.

Quoting from the national poet, Taras Shevchenko, Mr. Poroshenko said that “Ukraine will no longer drink Moscow poison from the Moscow cup,” and he called on supporters to remember the day’s events as “the final acquisition of independence from Russia.”

The assumption here is, of course, that (a) the tiny, endangered church in Constantinople has the power — there is no Vatican in Orthodox polity — to create an “autocephalous” Ukrainian church that will be recognized as valid by Orthodox churches around the world. Oh, and (b), the heart of this story is a conflict between Russian President Vladimir Putin and modern Europe, representing the free world.

Political sizzle always trumps church history.

About that 'Christmas miracle': What it means that Nashville has lost its only abortion provider

Nashville, Tenn. — one of the 25 largest cities in America — has lost its last remaining abortion provider. At least for now.

That seems like a pretty major story.

And indeed, The Tennessean has the basic details on today’s front page.

But the newspaper’s coverage of this stunning development seems overly low-key and matter-of-fact. Ho-hum, in other words.

This is the lede:

The only remaining abortion clinic in Nashville has ceased offering abortions, instead referring patients to clinics hundreds of miles away in Knoxville and Memphis. 

Officials with Planned Parenthood of Tennessee and North Mississippi, which operates the north Nashville clinic, could not say when the clinic would resume providing abortions. The organization has a shortage of abortion providers, a spokeswoman said.

It is also "undergoing a period of quality improvement and will return with these services soon," a statement said. 

It is the second clinic in Nashville to stop providing abortions this year. The Women's Center closed in August after the sale of its building and its operators said then they hoped to reopen. The center has not yet reopened. 

The suspension of abortion services at Nashville's only abortion clinic comes at a time when the number of abortion providers in Tennessee and throughout the Southeast continues to dwindle.

OK, but here’s my question as a reader: What in the world is going on here?
